From 5 January 2026, all CCS eligible families can get at least 72 hours of subsidised care per fortnight. These changes are known as the 3 Day Guarantee.

Approved children's education and care services across Australia are assessed and rated by their state and territory regulatory authority. The NQS is part of the National Regulations and includes seven quality areas that are important to children's learning and developmental outcomes.

These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

A condition is placed on this provider approval that children enrolled in preschool sessions in line with the Early Entry for Children with English as an Additional Language procedure will not be included within the maximum number of places at services approved under this provider. The children must be enrolled under the following circumstances; attending the service for a maximum of six hours per week, with a daily maximum of three hours; be accompanied by an adult; attend for negotiated session times; be placed in consultation with the Principal of the school; and a maximum of two placements be offered in each preschool group.
