These are actions taken by the State or Territory regulatory authorities when a service is found to be not complying with National Health and Safety regulations. These actions range in severity and are designed to improve and ensure children’s safety and wellbeing.

What is an enforcement action?

The regulatory authority may amend the provider or service’s approval to operate.

Compliance notices or directions include formal instructions for a service to rectify compliance issues.

Conditions placed on a service or provider approval require the service or provider to undertake specific actions to be compliant.

 – Emergency action notices require immediate steps to be taken by the provider to address serious risks at a service.

 – Enforceable undertakings are legally binding agreements that can be made between a regulatory authority and an approved provider or an individual. They set out what that approved provider or individual agrees to do or refrain from doing to comply with the National Law.

 – In extreme cases, the provider or service may temporarily lose their approval to operate.

Definitions

The approved provider must ensure that at all times when moving between approved spaces the enrolled children are accompanied by a contact staff member.

The Approved Provider must ensure that all staff are familiar with the supervision plan and safety audit for this service.”

The approved provider must ensure that all children attending the outside school hours care program must be at least 4 years of age by 30 June in the year they attend the program.

The approved provider must ensure that only children who are currently enrolled in, and attend or will attend, a school in the current year attend the outside school hours care program.

The approved provider is to ensure that at all times enrolled children over preschool age require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member.

The approved provider must ensure that all staff are familiar with the supervision plan and safety audit for this service.

•	    An approved provider of an education and care service that is listed on the Department of Education & Training Bushfire At-Risk Register must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

1. At least one educator is to be a consistent staff member at each service, at all times. This must be someone that holds at least a responsible person delegation or higher.
2. All responsible persons are to be fully inducted to each service they are designated at. This induction must be specific to the service and reflect service specific considerations. Evidence must be able to be provided on request.
3. An induction document is created for each NT service that includes updated information specific to the service. This must include consideration to service and provider specific responses to incident reporting, checking authorised persons, actioning health needs of children and emergency management and procedures. Evidence of the induction documents development must be provided to the regulatory authority within 30 days of the date of the condition being applied.
4. The induction document must be updated and monitored by approved provider and nominated supervisor regularly.
5. Evidence of all staff having read and understood the service specific induction must be able to be recorded and demonstrated on request.

The approved provider is to ensure that at all times enrolled children preschool age or under require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member, including while in the bathroom.

The approved provider is to ensure that at all times enrolled children over preschool age require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member.

The approved provider must not commence operating the service until 11 November 2024, which is the date from which the approved provider has the right to occupy the premises as indicated in the agreement between the approved provider and Bankstown North Public School.

This service is approved to provide education and care to children over preschool age up to and including school children before school, after school and during school holidays.

For the waiver for Regulation 126 to apply, the service is permitted to have only 1 less qualified educator than required at any given time. 
Additionally, you are not permitted to educate and care for more than 11 preschools at any time.

The approved provider must ensure that all children attending the outside school hours care/vacation care programs must be at least 4 years of age by 30 June in the year they attend the program.

The approved provider must ensure that the number of children educated and cared for by the service at any one time must not exceed the maximum number of children specified in the service approval.

The approved provider must ensure that its service, located at 160 Bennett Springs Dr Beechboro, only operates between 6:30am and 8:45am and 3:00pm and 6:00pm on weekdays during school terms, except for pupil free days as designated by the school where the service can operate between 6:30am and 6:00pm

The approved provider must ensure that a nominated supervisor conducts a face-to-face review of all employees’ satisfactory understanding of the service specific supervision risk assessment and the staff contingency plan (review). The review is not to be conducted via video-conferencing facilities.

The approved provider must ensure that the review is conducted with all current employees as soon as reasonably practicable and with new employees prior to them commencing at the service.

The approved provider is to ensure that at all times enrolled children preschool age or under require access to and from the toilet facilities, they are accompanied and supervised by a contact staff member, including while in the bathroom.

An approved provider of an education and care service that is listed on the Department of Education Bushfire At-Risk Register must ensure that: 

a. The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located. 

b. The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks. 

c. The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes: 

i. a list of the service's emergency contact details 

ii. procedures for monitoring and managing bushfire and grassfire risks and events 

iii. procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service 

iv. procedures for notifying families of children enrolled at the service of any closure 

v. procedures for reviewing and updating the Emergency Management Plan. 

d. A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

6. The outdoor verandah space must always be set up in a manner that allows for the expansion of the indoor space available for children.

This service is approved to provide education and care to children from over preschool age including school.

An approved provider of an education and care service that is listed on the Department of Education Risk of Grassfire (Category 4) must ensure that:  
 
•	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located. 
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks. 
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes: 
o	a list of the service's emergency contact details 
o	procedures for monitoring and managing bushfire and grassfire risks and events 
o	procedures for identifying and managing events that may cause planned, unplanned, or pre-emptive closure of the service 
o	procedures for notifying families of children enrolled at the service of any closure 
o	procedures for reviewing and updating the Emergency Management Plan. 
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

he Approved Provider must ensure that the service operates with a minimum of two staff members at all times to ensure children are adequately supervised when accessing the children's bathroom and outdoor space.

the approved provider must ensure that the swimming pool on the service premises is: 

not accessed or utilised by children being educated and cared for by the service, and 

enclosed with a fence or barrier of a suitable design, height and location to prevent a child from going over it, through it or under it; and children are prevented from entering the enclosed area at all times.

The approved provider must ensure that all children attending the Outside School Hours Care/Vacation Care programs must be at least 4 years of age by 30 June in the year they attend the program.

The approved provider must ensure that at all times when moving between rooms the enrolled children are accompanied by a contact staff member.

For the purposes of regulation 356(2) a maximum of one educator who holds an ACECQA assessed approved diploma level qualification for working with children over pre-school age in Queensland can be counted in the ratios of diploma qualified educators.

The approved provider must ensure that regular support is provided to the service by the Nominated Supervisor during the waiver period, including fortnightly in person service visits.

When the service is operated as a single staff model, the approved provider must ensure that all times the service provides education and care a responsible adult is present at the service and/or immediately available to support the program where required.

The approved provider must engage with a diploma qualified educator for the purposes of developing and implementing the education program being delivered to children being educated and cared for at this service.

The approved provider must take reasonable steps to recruit educators who have, or are actively working towards, at least an approved diploma level education and care qualification.

The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.

•	The approved provider must ensure that, for each child being educated and cared for by the service, the education and care service premises has at least 2 square metres of unencumbered indoor space.  This applies only to the indoor unencumbered space referred to on service plans as FR0021 and FR0025. Unencumbered indoor space of 3.25 square metres still applies to space referred to on service plans as DR001.

•     An approved provider of an education and care service that is listed on the Department of Education & Training Category 4 List – at some risk of bushfire or grassfire must ensure that: •	The service does not operate on any day that the Victorian Emergency Management Commissioner declares as having a 'Catastrophic' Fire Danger Rating that applies to the area or district at which that service is located.
•	The service's emergency and evacuation policies and procedures required under regulation 168 of the Education and Care Services National Regulations include an Emergency Management Plan for managing the service's bushfire and grass fire related risks.
•	The service's Emergency Management Plan is kept up to date, reflects the service's operating context, is reviewed at least once each calendar year, and includes:
o	a list of the service's emergency contact details
o	procedures for monitoring and managing bushfire and grassfire risks and events
o	procedures for identifying and managing events that may cause planned, unplanned or pre-emptive closure of the service
o	procedures for notifying families of children enrolled at the service of any closure
o	procedures for reviewing and updating the Emergency Management Plan.
•	A copy of the service's Emergency Management Plan is made available to the Regulatory Authority on request.

The Approved Provider must ensure indoor and outdoor unencumbered calculations as per Regulations 107 and 108, are provided as soon as they become available and no later than 31 March 2023.
